Amendment in Rule 205 of the Rules of Procedure.- that in the Rules of Procedure and Conduct of Business in the National Assembly, 2007, after rule 205, the following new rules 205A and 205B, shall be added, namely:-
“Committee on Scrutiny of Delegated Legislation
205-A. Composition.- A Standing Committee, to be called the Committee on Scrutiny of Delegated Legislation shall be appointed by the Speaker of the National Assembly at the commencement of every National Assembly. The Committee shall be nominated for the term of
the National Assembly:-
(a) The Committee shall consist of not less than fifteen members.
(b) The Committee shall have the power to send for persons, papers, and records.
(c) The Committee may make its own rules.
205-B. Functions of Committee.- (1) The Committee shall examine all regulations, rules, byelaws
and statutory regulations, orders made or given under any law, or ordinance after an order,

regulation, or bye-law is published in the Gazette, a copy is to be made available to the
Secretariat of the National Assembly which will table it in the Committee on Scrutiny of
Delegated Legislation. The Committee in turn shall examine the order for the following:-
(a) whether it complies with the constitution and the fundamental rights of citizens;
(b) whether it operationalizes the principles of the law as envisaged by the Majlis-e-
Shoora (Parliament);
(c) whether the scope and the content of the order is such that it requires enactment of
laws or amendments;
(d) whether it contains any financial implications;
(e) whether it bars the jurisdiction of a court of law;
(f) whether it allows a retrospective effect contrary to the law; and
(g) whether it calls for further clarification.
(2) The Committee may examine the Bills laid in the House for the scope and form of
delegated legislation that is being provided for and suggest recommendations therein.
(3) The Committee may conduct public hearings or field visits to examine how the order, bylaw,
regulation is being applied for further scrutiny or oversights of the implementation of law.
(4) The Committee shall lay detailed report of their examination of the delegated legislation
and the recommendations made to the Government to the House.
(5) If, on scrutiny the order, by-law or regulation concerned violates any of the principles
stated in sub-rule (1), a disapproval motion may be moved by any member, and if it is agreed to
by the House, it will cease to have effect”.
